Terms of service
These terms apply to every report requested from AVA Land ("we," "us"). By requesting a report you agree to them. Please read them; they are short and they matter.
What a report is
An AVA Land report is a research product. It compiles and interprets public records and public data about a specific land parcel: federal flood mapping, the USDA soil survey, state and county parcel and tax records, county land use documents, and, on a Verified Report, written responses from public offices. Each figure records its source and the date it was retrieved.
What a report is not
A report is not, and must not be treated as, any of the following: a land survey or determination of boundaries; an appraisal, broker price opinion, or opinion of value; a title search, title opinion, or title insurance; a soil evaluation, site evaluation, or septic permit determination; a wetland delineation or environmental assessment; a zoning verification letter; or legal, tax, or investment advice. Where a report refers to those matters, it is reporting what public sources say and telling you which licensed professional the parcel requires. Acreage figures come from county GIS geometry and are approximate. Price context is drawn from public assessments and public market benchmarks and is not an opinion of value.
Public data has limits
Public databases contain errors, lag recent changes, and vary in quality by county. We report what they contain as of the retrieval date and disclose any source we could not reach. We do not guarantee that a record is complete, current, or free of error, and we do not guarantee the outcome of any transaction, permit application, or professional evaluation.
Verified Reports
On a Verified Report we send written inquiries to the relevant public offices and record their responses, with the office, the respondent where given, and the date. We report the response as received. We do not control whether or when an office responds; typical timing is five to ten business days, and some offices answer only by phone or after a fee. Where an answer cannot be obtained in writing, the report says so.
Turnaround, pricing, and refunds
You will receive a confirmed price and delivery date within one business day of your request, and no work is billed until you confirm. Reports are delivered within 48 hours of confirmation unless the confirmation states otherwise. If we cannot produce a report for a parcel (for example, the parcel cannot be located in county records), you are not charged. If a delivered report contains a material error in a reported figure that we introduced, we will correct and reissue it at no charge. Because a report is custom research delivered on request, it is otherwise not refundable once delivered.
Your use of the report
The report is prepared for the person or firm that requested it. You may share it with parties to your transaction, including agents, attorneys, lenders, appraisers, and buyers or sellers, and a listing broker may attach it to a listing. Anyone who receives it takes it subject to these terms and is responsible for their own due diligence. You may not resell reports, remove the disclaimers or source citations, or present a report as a survey, appraisal, title opinion, or professional evaluation.
Limitation of liability
To the fullest extent permitted by law, our total liability for any claim connected with a report is limited to the fee paid for that report. We are not liable for indirect, incidental, or consequential losses, including lost profits or the outcome of any purchase, sale, financing, or development decision. Nothing in these terms limits liability that cannot be limited by law.
Requests and communications
Requests are made through the form on this site or by reply to our emails. By submitting a parcel you confirm you have a legitimate interest in it as a buyer, seller, owner, agent, or advisor. We may decline any request. Our handling of the information you submit is described in the privacy policy.
Changes and governing law
We may update these terms; the version in force when you confirm a request applies to that report. These terms are governed by the laws of the State of North Carolina.
